EULA - End User License Agreement

This End User License Agreement (this "EULA") contains the terms and conditions regarding your use of the SOFTWARE (as defined below) and material limitations to your rights in that regard. You should read this EULA carefully.

By installing the Probability Calculator software (hereinafter the "SOFTWARE"), you are accepting the following EULA.

I) DISTRIBUTION:
This software product is a shareware. Users must purchase license after 30 days of trial use. Registered users will receive fully functional copy (registration key). You may distribute the software as long as it remains in its original non modified state.

II) REGISTRATION:
By registering this software, the author grants you, that you may install and use one copy of the SOFTWARE on a single computer, including a workstation, terminal or other digital electronic device ("COMPUTER").

III) COPYRIGHT:
The software product is owned by author and is protected by Slovenian copyright laws, international treaty provisions and all other applicable national laws. Therefore, you must treat the product like any other copyrighted material (e.g. a book) except that you may make copies of the product provided that you keep the registered original solely for backup and archiving purposes.

IV) OTHER RESTRICTIONS:
You may not rent or lease the REGISTERED software product, but you may transfer your rights under this license agreement on a permanent basis provided that you transfer all copies of the software and all accompanying materials, and the recipient agrees to the terms of this agreement. Any transfer must include the most recent update and all prior versions. You may not alter, modify or adapt the component, including, but not limited to,
translating, recompiling, reverse engineering or disassembling. The author retains all rights not expressly granted. This license and your right to use the software automatically terminate if you fail to comply with any provision of this license agreement.

V) LIMITATION OF LIABILITY:

1. Disclaimer
Dew Research's entire liability and your exclusive remedy under this EULA shall be, at Dew Research's sole option, either (a) return of the price paid for the SOFTWARE; (b) repair the SOFTWARE through updates distributed online. Dew Research cannot and does not guarantee that any functions contained in the Software will meet your requirements, or that its operations will be error free. The entire risk as to the Software performance or quality, or both, is solely with the user and not Dew Research. You assume responsibility for the achievement of your intended results, and for the installation, use, and results obtained from the SOFTWARE.

2. Warranty.
Dew Research makes no warranty, to the maximum extent permitted by law, either implied or expressed, including with-out limitation any warranty with respect to this Software documented here, its quality, performance, or fitness for a particular purpose. In no event shall Dew Research be liable to you for damages, whether direct or indirect, incidental, special, or consequential arising out the use of or any defect in the Software, even if Dew Research has been advised of the possibility of such damages, or for any claim by any other party. All other warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose, are expressly excluded.
